A little history

It began as a diner in a restaurant in Driebergen (The Netherlands) among 4 pricing managers and Pol Vanaerde, all clients at that time of Pol. It was a continuation of several months of discussions between them how they could share best practices and learn from each other.

There was no organisation supporting the pricing community in Europe. By the conclusion of the diner, it was decided that a new organization should be formed to provide a means for pricing managers to share best practices, to learn and discuss common problems in a legal correct environment, respecting the competitive legislation.

The principles, code of conduct (checked by competitive lawyers 'Stibbe') and organisation were evaluated and decided. Pol Vanaerde was asked to set-up the formal membership organisation and the discussions resulted in the first formal EPP Pricing Refuel Days in Amsterdam, shortly thereafter followed by trainings and the need for a certification program and ... much more.

From the start , the EPP is designed around 3 important principles;

Thank you for using the EPP Learning Platform ! 

 These “Terms of Use for participants of online programs”  for participants of online programs”  (hereafter as "Terms") were last updated on September 15 , 2020. 

 EPP’s mission is to support organizations to dramatically improve top line revenues and profitability through personal and organizational Pricing and Revenue Growth Management maturity development.  We consider our EPP platform model the best way to offer valuable best practices to the pricing and revenue management community.  

 These Terms apply to all your activities on the EPP Learning Platform or the mobile applications of it.  If we publish an online course on the EPP learning platform, trainers must agree to the “Trainer Terms for online programs”.  

 We also provide details regarding our processing of personal data for people registering to the online course in our “Privacy & Data Protection Policy”.  

1. Course Enrolment as participant 

When you enrol in a course, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to view the course via the EPP Learning Platform.  

 Under our Trainer Terms for online courses, when trainers publish a course on the EPP learning platform, they grant EPP to offer a license to the course to subscribers of the course.  

As a participant, when you enrol in a course, you are getting a license from EPP to view the course via the EPP learning platform and EPP is the licensor of record.  

For a good understanding ; courses are licensed, and not sold, to you. This means that this license does not give you any right to resell the course in any manner (including by sharing account information with a purchaser or illegally downloading the course and sharing it on torrent sites). 

In pure legal terms : EPP grants you (as a participant) a limited, non-exclusive, non-transferable license to access and view the courses and associated content for which you have paid all required fees, solely for your personal, non-commercial, educational purposes, in accordance with these Terms.  

All other uses are expressly prohibited. You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any course unless we give you explicit permission to do so in a written agreement signed by a EPP authorized representative. This also applies to content you can access via any of our APIs. 

 

2. Pricing and payments 

When you make a payment, you agree to use a valid payment method.  

2.1 Pricing 

The prices of courses on EPP are determined by EPP.  We may run promotions for certain courses.  The price applicable to a course will be the price at the time you complete your purchase of the course (at checkout).   

Any price offered for a particular course may also be different when you are logged into your EPP Prime account from the price available to users who aren’t registered or logged in, because some of our promotions are available only to EPP Prime members.

 

2.2 Payments 

You agree to pay the fees for courses that you purchase, and you authorize us to charge your debit or credit card or process other means of payment (such as Boleto, SEPA, direct debit, or mobile wallet) for those fees. EPP works with third party payment processing partners to offer you the most convenient payment methods in your country and to keep your payment information secure.  

When you make a purchase, you agree not to use an invalid or unauthorized payment method. If your payment method fails and you still get access to the course you are enrolling in, you agree to pay us the corresponding fees within thirty (30) days of notification from us. We reserve the right to disable access to any course for which we have not received adequate payment. 

3. EPP’s Rights 

All right, title, and interest in and to the EPP learning platform, including our website, our existing or future applications, our APIs, databases, and the content our employees or partners submit or provide (but excluding content provided by trainers and participants) are and will remain the exclusive property of EPP. Our platforms and services are protected by copyright and trademark. Nothing gives you a right to use the EPP name or any of the EPP trademarks, logos, domain names, and other distinctive brand features.  

You may not do any of the following while accessing or using the EPP platform and Services: 

  • access, tamper with, or use non-public areas of the EPP learning platform (including content storage), EPP’s computer systems, or the technical delivery systems of EPP’s service providers. 
  • access or search or attempt to access or search our platform by any means (automated or otherwise) other than through our currently available search functionalities that are provided via our website, mobile apps, or API (and only pursuant to those API terms and conditions). You may not scrape, spider, use a robot, or use other automated means of any kind to access the Services. 
     
  • in any way use the EPP learning platform to send altered, deceptive, or false source-identifying information (such as sending email communications falsely appearing as EPP); or interfere with, or disrupt, (or attempt to do so), the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the platforms or services, or in any other manner interfering with or creating an undue burden on the EPP services. 

 

4. Binding agreement

You agree that by registering, accessing, or using our EPP Learning Platform, you are agreeing to enter into a legally binding contract with EPP. If you do not agree to these Terms, do not register, access, or otherwise use any of our Services. 

If any part of these Terms is found to be invalid or unenforceable by applicable law, then that provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms will continue in effect. 

Even if we are delayed in exercising our rights or fail to exercise a right in one case, it doesn’t mean we waive our rights under these Terms, and we may decide to enforce them in the future. If we decide to waive any of our rights in a particular instance, it doesn’t mean we waive our rights generally or in the future. 

 

5. Disclaimers

It may happen that our platform is down, either for planned maintenance or because something goes down with the site. You accept that you will not have any recourse against us in any of these types of cases where things don’t work out right.  

In pure legal terms : the courses and their content are provided on an “as is” and “as available” basis. We (and our affiliates, suppliers, partners, and agents) make no representations or warranties about the suitability, reliability, availability, timeliness, security, lack of errors, and expressly disclaim any warranties or conditions (express or implied), including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.  

We are not responsible for delay or failure of our performance of any of the online courses caused by events beyond our reasonable control, like an act of war, hostility, or sabotage; natural disaster; electrical, internet, or telecommunication outage; or government restrictions.

 

6. Indemnification 

If you behave in a way that gets us in legal trouble, we may exercise legal recourse against you. You agree to indemnify, defend (if we so request), and hold harmless EPP and their directors, employees, suppliers, partners, and agents from an against any third-party claims, demands, losses, damages, or expenses (including reasonable attorney fees) arising from (a) the content you post or submit, (b) your use of the platform (c) your violation of these Terms, or (d) your violation of any rights of a third party. Your indemnification obligation will survive the termination of these Terms. 

 

7. Governing Law and Jurisdiction 

These Terms are governed by the laws of Kortrijk, Belgium without reference to its choice or conflicts of law principles.  

 

8. Updating These Terms 

From time to time, we may update these Terms to clarify our practices or to reflect new or different practices (such as when we add new features), and EPP reserves the right in its sole discretion to modify and/or make changes to these Terms at any time.  

 

Code of honour 
 

All participants in the online classes must agree to abide by the following code: 

  1. I will register for only one account, unless expressly permitted to register for additional accounts by EPP 
  2. My answers to ‘home' work, quizzes, exams, projects, and other assignments will be my own work (except for assignments that explicitly permit collaboration). 
  3. I will not make solutions to homework, quizzes, exams, projects, and other assignments available to anyone else (except to the extent an assignment explicitly permits sharing solutions).  
  4. I will not engage in any other activities that will dishonestly improve my results or dishonestly improve or hurt the results of others.

Terms and Conditions

Version February 2020.

The following definitions apply to the terms and conditions of the EPP Pricing Platform:

  • EPP Pricing Platform (hereafter 'EPP'): the organisation offering and providing products and services to professionals both EPP members and non-members ;
  • EPP Member : party paying a yearly participation fee to get access to the online portal site resources and content, event discounts on the events organised by EPP;
  • Non-Members: The party commissioning the engagement in one or more selected events, organised by EPP;
  • EPP Events: include EPP Seminars, Open Trainings, Forums, Events, CPM® programmes, in-company trainings, and other frequent or non-frequent sessions organised by EPP.  All events are announced on www.pricingplatform.com and/or https://events.pricingplatform.com/.

These terms and conditions apply to all products and services, produced and provided by EPP.

  1. EPP Membership Plan Registration

    1. Registration
      1. Registration requires filling out the complete online registration form, the contract is concluded under the terms and coniditions;
      2. Registration is only accepted and confirmed after payment of the annual membership fee, as mentioned on the EPP website, is received in full;
      3. The registrant automatically accepts the guidelines as stated in EPP's Code of Conduct, and will act accordingly.
    2. Payment conditions
      1. Online payment: payment is due at the time of registration;
      2. Payment after invoice: payment is required within 21 days after invoice date. All invoices, unless stated otherwise, carry a ten per cent (10%) late payment surcharge.
    3. Duration/validity
      1. A participation plan lasts for the terms of twelve (12) months, starting the month (per date) you receive a written confirmation from the EPP.
      2. A participation plan is renewed each twelve (12) months.   You will get a notification approx. 2 weeks before the renewal date.  
    4. Cancellation, upgrading and substitution
      1. You can always upgrade or cancel your subscription plan at any moment.  Prices of an EPP Prime Membership plans may be subject to change and are displayed on the EPP website;
      2. EPP Prime Members have the right to transfer their participation plan to a colleague from the same company;
      3. EPP has the right to cancel a membership plan, if ie. a member does not act according to EPP's Code of Conduct. Upon such cancellation, the annual fee of the contract term of the participation plan is non-refundable.

  2. EPP Event registration (trainings, seminars, workshops, webinars, forums, and content download etc.)

    1. EPP Event registration 
      1. Registration requires filling out the complete online registration form on www.pricingplatform.com and/or https://events.pricingplatform.com/ and is concluded under these terms and conditions;
      2. The fees and value per event are mentioned in the programme details;
      3. The registrant automatically accepts the guidelines as stated in EPP's Code of Conduct, and will act accordingly.
    2. Payment conditions
      1. Online payment: payment is due at the time of registration;
      2. Payment after invoice: payment is required within 21 days after the invoice date. All invoices, unless stated otherwise, carry ten percent (10%) late payment surcharge;
      3. Full payment must always be received prior to the event date. EPP reserves the right to refuse admission and/or cancel your registration if payment is not complete before the start of the event.
    3. Cancellation of a registered participant
      1. Cancellation requests must always be in writing (post or email) to the event organiser at EPP;
      2. Registrants may cancel and receive a full refund of the event registration fee, minus a twenty per cent (20%) administrative fee, until sixty (60) days prior to the event;
      3. Fifty percent (50%) of the pre-paid registration fee will be refunded for cancellations received between fifty-nine (59) to thirty (30) days prior to the event;
      4. Thirty per cent (30%) of the pre-paid registration fee will be refunded for cancellation received between twenty-nine (29) days to ten (10) days prior to the event;
      5. No refunds are available for cancellations less ten (10) days prior to the event, or for no-shows;
      6. In case of cancellation less than 10 days prior to the event, or no-shows, registrants will also be charged in full for their eventual hotel and transportation reservations, if made on their request via EPP;
    4. Substitution of a registered participant
      1. Substitution requests must always be in writing (post or email) to the event organiser at EPP;
      2. Registrants may substitute delegates, at no extra charge, until five (5) working days prior to the event. Substitution, less than five (5) working days before the event, is not accepted.
    5. Cancellation, postponement or alterations of events
      1. EPP reserves the right to cancel or postpone events/sessions, or alter the country, location or venue in case of force-majeur, unforeseen circumstances, or if minimum registration numbers are not met;
      2. In case of cancellation, postponement or alteration by EPP, registrants will receive a rollover credit for attendance at the rescheduled session, taking place within (12) months from the original date.
      3. EPP does not take any responsibility for cancelling or refunding the accommodation and/or transportation booked by registrants or by the EPP on request of a registrant. EPP recommends that registrants take out cancellation insurance for such situations.
    6. Change to Event Program
              The organizers reserve the right to make changes to the programme content, speakers, timing, venue or date of the event compared to the                   advertised programme without notice.
    7. Filming
      1. EPP might produce pictures and/or videos of their events.  Participants give permission for their personal images and voices to be used in video materials and pictures produced for EPP Pricing Platform. 
      2. The video materials may be used on a variety of platforms including websites and digital file formats for internal and external audiences.   Your personal contribution will only be used in the context of European Pricing Platform materials and for no other purpose unless you give prior consent.     

          8. Personal Information

1. Your personal information submitted to EPP Events may be shared with event partners, third-party service providers, and third-party workshop/exhibit hosts.

2. By registering for the Event and downloading our content, the registrants agree and acknowledge that their personal information may be shared with the aforementioned parties, and that such parties may contact them in the future. Registrants also agree and acknowledge that their personal information will be used to create a delegate list for the event, which may be shared with other attendees. Registrants who do not want to be included on this list must inform EPP Events during the booking process.
